From time to time, we may refer to that information to better understand your needs and how we can improve our services. We may use that information to contact you. We, and/or our authorized Third Party Service Providers and Advertisers, may automatically collect this Non-Personally Identifiable information when you visit our Website through the use of electronic tools like Cookies and Web beacons or Pixel tags, as described below.

Location Information: When you use the Services, we may collect and store general location information (such as IP address). If you permit the Services to access location services through the permission system used by your mobile operating system (“Platform”) or browser, we may also collect and store the precise location of your device when the TowGig app is running in the foreground or background of your device. This information may be used to help you select your delivery address, to provide more accurate deliveries of your orders, to provide recommendations to you, and to enhance your user experience and improve the services. You can choose whether to enable the location tracking feature through the settings on your device or Platform or when prompted by the TowGig mobile app. If you choose to disable the location feature, the service provider(expert) will not receive precise location information from your device, which may compromise the accuracy of deliveries in some situations, for instance, if you are located in a large area, such as a park, or bypass road or highway.

Information Related to the Referral Program: TowGig allows users to invite friends and family to sign up for our Services. Sometimes we offer a promotional value for every friend or family member who signs up and places an order through your referral link. To help you do this, we may request you to grant us access to your mobile device address book. You can then direct us to send referral emails to contacts you select in your address book. By sending a referral, you also consent to TowGig sending your public profile image to the contacts you select to receive a referral link. By choosing to invite a friend you represent that you have received the friend’s consent to provide his or her name and email address with us. TowGig will use that information to send an email or any mean of inviting him or her to visit the site and will store that information to track the success of the referral program and may send marketing emails. You can also send an SMS with a referral link to your contacts. If you use this option, you understand that TowGig does not control the timing, content, or recipients of these SMS messages.

Why user background location is needed: TowGig Technologies, is an ondemand service providing platform that is mainly running on location based service providing system. The platform is built to accommodate 2 types of parties. The buyer who's seeking service, and expert, who's providing services. The job assignment algorithm is based upon distance between the buyer and expert. Hence, the background location feature is needed, because when a buyer request a job, the algorithm calculate the distance between the buyer seeking service and alert all the service providers within a given radius. When our algorithm hit the experts current location it then return to our system(server) to calculate the distance between the buyer and expert on the basis of live locations between both users. The system then decide what expert to assign the job to. The expert after accepting the job, move to the buyer's exact location to perform the task. For this entire process to be accurate and effective both users are recommended to allow the background location feature in the app for better delivery experience. Therefore, without the background location system, TowGig app, is completely redundant.

Web Beacons: “Web beacons” (also known as “clear gifs” and “pixel tags”) are small transparent graphic images that are often used in conjunction with cookies in order to further personalize our website for our users and to collect a limited set of information about our visitors. We may also use web beacons in email communications in order to understand the behavior of our customers. We do not link the web beacons to any PII.

Log Files: Any time you visit any of our websites, our servers automatically gather information from your browser (such as your IP addresses, browser type, Internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of clicks) to analyze trends, administer the site, prevent fraud, track visitor movement in the aggregate, and gather broad demographic information. For example, we may log your IP address for system administration purposes. IP addresses are logged to track a user’s session. This gives us an idea of which parts of our site users are visiting. We do not share the log files externally. We also collect information about you when you register or subscribe to any of our services.

We take precautions to protect your information. When you submit sensitive information via the website, your information is protected both online and offline. Wherever we collect sensitive information (such as credit card data), that information is encrypted and transmitted to us in a secure way.   • We may share your information with Authorized Third Party Service Providers: We provide some of our services and products through third parties. These "Third Party Service Providers" perform functions on our behalf, like sending out and distributing our administrative and promotional emails. We may share your Personally Identifiable Information with such Service Providers to send postal or email, remove repetitive information on customer lists, analyze data, provide marketing assistance, provide search results and links, operate the Website, troubleshoot, and provide customer service. Notwithstanding the foregoing sentence, Personal Data does not include information that TowGig Technologies processes in the context of services that it provides directly to a consumer; and
(d) All other capitalized terms in this Addendum shall have the same definition as in the Agreement.

Data Protection
  1. Where a Data Subject is located in the European Economic Area, that Data Subject’s Personal Data will be processed by United States of America basedservers.
  2. When TowGig Technologies Processes Personal Data in the course of providing the Services, TowGig Technologies will:
    • Process the Personal Data as a Data Processor, only for the purpose of providing the Services in accordance with documented instructions from you (provided that such instructions are commensurate with the functionalities of the Services), and as may subsequently be agreed to by you. If TowGig Technologies is required by law to Process the Personal Data for any other purpose, TowGig Technologies will provide you with prior notice of this requirement, unless TowGig Technologies is prohibited by law from providing such notice;
    • notify you if, in TowGig Technologies' opinion, your instruction for the processing of Personal Data infringes applicable Data Protection Legislation;
    • notify you promptly, to the extent permitted by law, upon receiving an inquiry or complaint from a Data Subject or Supervisory Authority relating to TowGig Technologies' Processing of the Personal Data;
    • implement and maintain appropriate technical and organizational measures to protect the Personal Data against unauthorized or unlawful processing and against accidental loss, destruction, damage, theft, alteration or disclosure. These measures shall be appropriate to the harm which might result from any unauthorized or unlawful processing, accidental loss, destruction, damage or theft of Personal Data and appropriate to the nature of the Personal Data which is to be protected;
    • provide you, upon request, with up-to-date attestations, reports or extracts thereof where available from a source charged with auditing TowGig Technologies' data protection practices (e.g. external auditors, internal audit, data protection auditors), or suitable certifications, to enable you to assess compliance with the terms of this Addendum;
    • notify you promptly upon becoming aware of and confirming any accidental, unauthorized, or unlawful processing of, disclosure of, or access to the Personal Data;
    • ensure that its personnel who access the Personal Data are subject to confidentiality obligations that restrict their ability to disclose the Customer Personal Data; and
    • upon termination of the Agreement, TowGig Technologies will promptly initiate its purge process to delete or anonymize the Personal Data. If you request a copy of such Personal Data within 60 days of termination, TowGig Technologies will provide you with a copy of such Personal Data.
  3. In the course of providing the Services, you acknowledge and agree that TowGig Technologies may use Subprocessors to Process the Personal Data. TowGig Technologies' use of any specific Subprocessor to process the Personal Data must be in compliance with Data Protection Legislation and must be governed by a contract between TowGig Technologies and Subprocessor.
GROUNDS FOR PROCESSING

When we collect from you any personal information within the scope of European data protection laws, we do so (a.) with your consent; (b.) where necessary to provide the Service, fulfill a transaction or otherwise perform a contract with you or at your request prior to entering into a contract; (c.) where necessary for our compliance with a legal obligation; (d.) where necessary for the performance of a task carried out in the public interest; and/or (e.) as necessary to fulfill our legitimate interests as described below, except where our interests are overridden by your privacy rights.
